| One of Averroes' (Ibn Rushd) earliest works is dedicated to law. The work comprises a summary of al-Ghazali's work on legal theory called al-Mustasfa min 'ilm al-usul. This volume presents a new edition of the Arabic text accompanied by a French translation and commentary. | Responding to the accusations of the Ašʿarite theologian al-Ġazālī, in his Decisive Treatise Averroes champions the practice of philosophy, using legal and scriptural arguments. In this article, I wish to place these arguments within the context of legal theory, a discipline to which Averroes devoted one of his earliest treatises, the Abridgment of al-Mustaṣfā . A comparison of these two texts allows us to identify the origin of some arguments of the Decisive Treatise, concerning the taxonomy of errors and the social organization of knowledge. My aim is to set Averroes’ reflection within a continuity of the Islamic meta-legal tradition that provided him with the necessary tools for his conceptualization of the philosopher’s place within society. |

| In his commentary on Metaphysics IX 3, Averroes draws an analogy between the Megarian conception of dunamis, presented and refuted by Aristotle, and that of the Ashʿarites theologians. The study of the Arabic translation of lemmatas of Aristotle’s text (1047a26-28) and of the reformulation by Averroes of the third argument against the Megarians shows a shift commanded by theological issues: since the omnipotence of God can now bypass natural powers, the question of who possess the power should be added to that of its sole possession. |

| In his commentary on Metaphysics IX 3, Averroes draws an analogy between the Megarian conception of dunamis, presented and refuted by Aristotle, and that of the Ashʿarites theologians. The study of the Arabic translation of lemmatas of Aristotle’s text (1047a26-28) and of the reformulation by Averroes of the third argument against the Megarians shows a shift commanded by theological issues: since the omnipotence of God can now bypass natural powers, the question of who possess the power should be added to that of its sole possession. |

| Responding to the accusations of the Ašʿarite theologian al-Ġazālī, in his Decisive Treatise Averroes champions the practice of philosophy, using legal and scriptural arguments. In this article, I wish to place these arguments within the context of legal theory, a discipline to which Averroes devoted one of his earliest treatises, the Abridgment of al-Mustaṣfā . A comparison of these two texts allows us to identify the origin of some arguments of the Decisive Treatise, concerning the taxonomy of errors and the social organization of knowledge. My aim is to set Averroes’ reflection within a continuity of the Islamic meta-legal tradition that provided him with the necessary tools for his conceptualization of the philosopher’s place within society. |

| One of Averroes' (Ibn Rushd) earliest works is dedicated to law. The work comprises a summary of al-Ghazali's work on legal theory called al-Mustasfa min 'ilm al-usul. This volume presents a new edition of the Arabic text accompanied by a French translation and commentary. The edition is preceded by a study that draws attention to the main points of difference between the two philosophers. L'un des premiers traités d'Averroès est consacré au droit. Il s'agit d'un abrégé de la somme de théorie juridique d'al-Ghazāli, al-Mustasfā min 'ilm al-usūl. Cette nouvelle édition du texte est accompagnée d'une traduction française et d'un commentaire qui replace les arguments dans leur tradition doctrinale, celle de la théorie juridique véhiculée par le Mustasfā, l'un des traités les plus marquants de cette discipline. |
